    说 明

 

1.本合同文本为示范文本,由广东省住房和城乡建设厅、广东省市场监督管理局共同制定,适用于广东省行政区域内的住房租赁。住房转租以及作居住功能使用的房屋租赁,可参考使用本合同文本。

2.签订本合同前,双方当事人应当出示有效身份证明,出租人应当向承租人出示房屋所有权证明或其他合法权属证明的原件。房屋属于共有的,应提供共有权人同意出租的书面证明;房屋属于委托出租的,应提供产权人的委托授权文件;房屋属于转租的,应提供房屋所有权人同意转租的书面证明。双方当事人应将相关证明和委托授权文件的复印件作为合同附件。

3.合同租赁期不得超过20年;超过20年的,超过部分无效。

4.本合同“下划线”部位的填写内容,由双方当事人协商确定,不作约定的应在“下划线”部位以划“×”的方式表示。本合同“□”中选择的内容,以划“√”的方式表示选定,以划“×”的方式表示不作约定,以示删除。

5.双方当事人填写的联系电话、证件类型、证号、通讯地址以及收付款账号等信息须真实准确,合同内容须填写清晰、无歧义。上述信息发生变化的一方应于变化后5日内通知对方。因上述信息有误或变化后未通知对方,导致未能有效接收有关通知文件的,相应后果由失误方自行承担。

6.双方当事人可以根据实际情况决定本合同原件及附件的份数,并在签订合同时认真核对,以确保各份合同及附件内容一致。在任何情况下,出租人和承租人都应当至少持有一份合同原件及附件。

7.本合同未尽事宜,双方当事人可在文本的空白行中进行补充约定,或另行签订补充协议,补充协议作为合同的组成部分,与本合同具有同等法律效力。

根据《中华人民共和国合同法》《中华人民共和国城市房地产管理法》等有关法律、法规、规章的规定,甲方和乙方本着自愿、平等、公平、诚实信用的原则,经协商一致,就住房租赁有关事宜达成如下协议:

第一条  房屋基本情况

(一)房屋坐落。

 租赁期限、租金及押金

(一)房屋租赁期限。

房屋的租赁期限为          个月,租赁时间自               日起至               日止(租赁期限不得超过二十年)。租赁期满后,甲方继续出租该房屋的,乙方在同等条件下有优先承租权,但应在租赁期满前30日内与甲方协商一致并签订新的租赁合同。

(二)房屋租金

2.租赁合同期内,甲方不得单独上调房屋租金。

甲方不得以任何手段限定乙方租金支付方式。

(三)房屋押金。

乙方应于                    日前将房屋押金一次性支付给甲方。租赁期满或合同解除,乙方结清相关费用(包括应由乙方承担的费用以及房屋附属物品、设备设施损毁赔偿金等)并按期搬出时,甲方应同时将押金返还给乙方。如乙方未按合同约定付清相关费用,甲方有权将押金用于抵扣相关费用,剩余部分应返还给乙方;不足以抵扣的,乙方应据实予以补足。

条  房屋交付和返还

(一)交付。

甲方应于                  日前将房屋按照合同约定交付给乙方。双方经房屋交验,在附件二《房屋交付确认书》中签字盖章并移交房屋钥匙后视为交付完成。房屋交付前的水费、电费、燃气费、物业管理费等相关费用由甲方承担。

(二)返还

租赁期满或合同解除,乙方应按照原状和《房屋交付确认书》返还房屋及其附属物品、设备设施,甲乙双方应对房屋和附属物品、设备设施及水电燃气使用等情况进行交验,结清各自应当承担的费用。乙方搬离且双方签订《房屋交还确认书》,视为房屋返还完成。

乙方在返还房屋前,应对房屋中属于乙方的物品进行搬离处理。乙方返还房屋后,乙方遗留在房屋中的物品,视为乙方放弃其所有权,甲方有权自行处理。

条  其他相关费用的承担

(一)租赁期内,甲方负责支付法律、法规规定应缴纳的房屋租赁相关税费,以及:

(二)乙方负责支付因使用房屋产生的:

(三)本合同中未列明的与房屋有关的其他费用均由甲方承担。如一方垫付了应由另一方支付的费用,应向另一方出示相关缴费凭据,另一方应返还相应费用。

(四)乙方损害房屋所属物业管理区域公共利益或相邻关系人合法权益而支付的费用,或因不当使用房屋行为导致第三人损失而支付的费用,应由乙方承担。

条  房屋使用维护

(一)乙方应遵守国家和地方的相关法律法规规定以及房屋所在小区的物业管理规约,按照规定的房屋用途使用房屋。房屋出租部位居住人数不得超过   人,不得安排人员在厨房、卫生间、阳台和地下储藏室居住。

(二)甲乙双方应共同保障房屋及其附属物品、设备设施处于适用和安全的状态:

1.乙方不得擅自拆改变动房屋结构及设施,不得增加外墙荷载,不得超载使用,不得堆放易燃易爆及危险物品,不得擅自装修。

2.若乙方需要对房屋进行室内装修或者增加设备的,必须经甲方书面同意,且甲方有权对工程进行监督。

3.对于房屋及其附属物品、设备设施因自然属性或合理使用而导致的损耗,乙方应及时通知甲方修复;或维修方案经甲方同意后,由乙方代为维修,费用由甲方承担。甲方应在接到乙方通知后          日内启动维修,未及时启动维修的,乙方可直接启动维修,费用由甲方承担。因维修房屋影响乙方使用的,应减少影响天数的租金或增加相应天数的免租金期限。

4.对于                            等易耗品因合理使用而导致的损耗,由乙方负责维修、更换。

5.因乙方使用不当,致使房屋及其附属物品、设备设施发生损坏或故障的,乙方应负责维修并承担赔偿责任。

 转租

未经甲方书面同意,乙方不得擅自将房屋转租。甲方同意转租的,乙方应确保第三人完全遵守本合同的约定,并应将转租情况以书面方式告知甲方。转租后因第三人对房屋造成损失的,由乙方负责赔偿甲方损失。

 优先购买权

租赁合同期内,甲方出售租赁房屋的,应在出售前3个月书面通知乙方,乙方应在收到甲方书面通知后     日内回复甲方是否愿意在同等条件下购买该房屋,逾期未回复的视为放弃对该房屋的优先购买权。

甲方在租赁合同期内出售租赁房屋的,乙方租赁合同期内继续占有使用租赁房屋的权利不受影响,合同期满后由买受人与乙方自行决定是否继续签订租赁合同。

 合同解除

(一)在合同有效期内,经双方当事人协商一致,可以解除本合同。

(二)因不可抗力导致本合同无法继续履行的,本合同自行解除。

(三)甲方有下列情形之一的,乙方有权单方解除本合同:

1.甲方逾期交付房屋     日的。

2.甲方交付的房屋经鉴定不符合建筑、消防、室内空气质量等方面的安全标准和要求。

3.甲方交付的房屋严重不符合合同约定,且乙方在房屋交付后     日内提出解除合同的。

4.甲方故意隐瞒与订立合同有关的重要事实或提供虚假情况影响乙方居住使用的。

乙方向本合同填写的甲方通讯地址邮寄送达《解除合同通知书》,可视为本合同已解除。

(四)乙方有下列情形之一的,甲方有权单方解除本合同:

1.乙方不按照约定支付租金连续达        日或累计达        日以上的,或欠交各类费用超过        元的。

2.乙方擅自将房屋转租给第三人的。

3.乙方未按照规定的房屋用途使用房屋、堆放易燃易爆及危险物品或利用房屋从事违法违规活动、损害公共利益的。

4.乙方擅自装修、拆改变动房屋结构及设施的。

甲方向本合同填写的乙方通讯地址邮寄送达《解除合同通知书》,可视为本合同已解除。

(五)具备其他法定合同解除情形的,可以解除本合同。

 违约责任

(一)甲方违约责任。

1.甲方逾期交付房屋,每逾期一日按照                    的标准向乙方支付违约金,逾期交付房屋的违约金计至甲方完成房屋交付之日或解除合同之日止。

2.甲方交付的房屋严重不符合合同约定、故意隐瞒与订立合同有关的重要事实或提供虚假情况影响乙方居住使用的,甲方按照                    的标准向乙方支付违约金。

3.甲方交付的房屋存在质量、安全等方面的问题,对乙方或者其他人造成人身伤害的,应当依法支付相关赔偿金。

4.甲方提前收回该房屋,应至少提前30日通知乙方,并按照            的标准向乙方支付违约金。

(二)乙方违约责任。

1.乙方逾期支付租金,每逾期一日按照                    的标准向甲方支付违约金,逾期支付租金的违约金计至乙方付清租金之日止。

2.乙方擅自将房屋转租给第三人,擅自改变房屋用途,或利用房屋从事违法违规活动、损害公共利益的,乙方按照                   的标准向甲方支付违约金。

3.乙方擅自装修、拆改变动房屋结构及设施,堆放易燃易爆及危险物品或因使用不当造成房屋及其附属物品、设备设施发生损坏或故障的,乙方应恢复原状或赔偿损失,并按照                    的标准向甲方支付违约金。

4.乙方提前退租,应至少提前30日通知甲方,并按照                  的标准向甲方支付违约金。

5.乙方逾期返还房屋,每逾期一日按照                    的标准向甲方支付违约金,逾期返还房屋的违约金计至返还房屋之日止。

第十  争议解决方法

本合同在履行过程中发生的争议,由双方当事人协商解决;协商不成的,可以通过下列第         种方式解决:

(一)依法向房屋所在地的人民法院起诉。

(二)提交            仲裁委员会裁决。

第十 送达条款

甲乙双方确认以本合同约定的通讯地址为双方之间书面文件往来及涉及仲裁、诉讼时仲裁机构、法院送达相关材料的送达地址,相关材料送达至上述地址即视为送达。一方变更地址或联系电话的,应以书面形式通知对方。

第十 房屋租赁登记备案

双方当事人应在本合同订立后30日内办理房屋租赁登记备案,办理方式为:

(一)甲乙双方自行签订租赁合同的,双方约定房屋租赁登记备案的办理人为:

房屋租赁登记备案的办理方式为:

□在房屋所在地的租赁备案受理点备案。

□在政府住房租赁管理服务网络平台备案。

(二)房屋租赁经营机构出租房屋,由经营机构办理房屋租赁登记备案手续。

(三)经房地产经纪机构促成签订房屋租赁合同的,可由房地产经纪机构办理房屋租赁登记备案手续。

(四)租赁合同期内,乙方符合当地政府规定的条件申请办理居住落户、义务教育、基本医疗、就业服务、社会保障等公共服务时,甲方应积极予以配合。

第十条  合同生效
